BEDFORD POLICE ARREST OF MITCHELL MAN BEING QUESTIONED

BEDFORD - MAY 21, 2023 - Lawrence County Zephyr have been asked to follow the developments in the arrest and trial of a Mitchell man.


Video: YouTube Video of a Mitchell man's arrest and threat of child being taken by the Indiana Department of Child Services have circulated over socail media this week


Jeremy A. Small, Mitchell, Indiana was arrested on October 6, 2022, by Bedford Police Department after a former off duty IU Health Police Officer B.J. Fulkerson made a 911 call to the department.


Small was arrested for resisting law enforcement, by knowing and intentionally to obstruct, and refusal to identify himself to the police officers. There is no record of Small being cited for any traffic violations.


However, during the video of the interaction with Bedford Police Department officers and Small the Bedford Police Department officers could not articulate the reason why Small was being arrested.


Small's young child was in the vehicle at the time of the arrest, and he was threatened that child protective services would take his child. During the threat the Bedford Police Officer did not communicate of why Small was being detained or any traffic violations that were committed during the traffic stop.


Officer B.J. Fulkerson has been recently hired by the Springville Community Academy as a school resource officer.


YouTube video of the body camera footage of the stop, and questions raised by a YouTube Group called Official Misconduct was circulated among social media platforms this week in Lawrence County.


Other YouTube video from the group Official Misconduct have circulated with Bedford Police Department and the Lawrence County Sheriff's Department officials have been circulated on social medial platforms.



Lawrence County Superior Court II Judge Bob Cline found that the Bedford Police officers did have probable cause in the case on October 11, 2022.


Small is being represented by Attorney Justin Tyler Boren, Martinsville, Indiana and a jury trial for Small has been scheduled on July 12, 2023.


Lawrence County Zephyr will be following the court case after members of the public requested it.


At this time, the Lawrence County Zephyr has not reached out to Bedford Police Department Chief Terry Moore or obtained a probable cause affidavit from Lawrence County Prosecutor's office at this time.


Lawrence County Zephyr will be researching this story and report further developments on this arrest and trial.


Lawrence County Superior Court Judge John Plummer III will be presiding over the jury trial with Lawrence County Prosecutor Sam Arp II representing the State of Indiana.
