Status Hearing Scheduled in North Lawrence Community School Public Access Lawsuit

LAWRENCE COUNTY - AUGUST 28, 2022 - In the lawsuit filed by the North Lawrence Community School vs. Jason Johnson, Jerry Ford, and Deanna Ford for public access records a Status Hearing has been scheduled on October 6, 2022.


The lawsuit was filed on January 31, 2020, in Lawrence County Circuit Court after the Indiana Public Access Counselor ruled that the North Lawrence Community School Corporation violated the Public Access Law.


On August 5, 2022, Glen E. Koch Attorney for Jerry and Deanna Ford filed for a Status Conference hearing at the court's convivence.


The North Lawrence Community School Corporation Attorney James G. Pittman filed for a continuance on August 16, 2022, due to a vacation scheduled by Pittman.


In February 2020, The North Lawrence Community School Corporation filed a motion for a Judicial Review of the Opinion of Luke Britt, Indiana Public Access Counselor. In August 2020 the Judge Holly M. Harvey, dismissed that request.


In Judge Harvey's ruling the court does not have the jurisdiction in the case over the Judicial Review. In the ruling to have jurisdiction, the order would have to be the " final agency action" the Indiana Public Access Counselor dues not final action decision and is only an advisory opinion.


The only remedy was for the North Lawrence Community Schools is a declaratory judgment that has already was filed in the lawsuit of NLCS vs Jason Johnson, Jerry Ford, and Deanna Ford.


North Lawrence Community Schools filed for the declaratory judgement to prevent Jason Johnson, Jerry Ford, from obtaining records from the Visionary Committee and information related to the consolidation of elementary schools and middle schools.
