Shawn Hays Declared Incompetent to Stand Trial in the Murder of his father

LAWRENCE COUNTY - JUNE 2, 2023 - Lawrence County Superior Court I Judge John Plummer III has ruled that Shawn Hays is incompetent to stand trial at this time.

After a competency hearing that was held in Lawrence County Superior Court I at 9:00 am Thursday morning and hearing testimony from expert witnesses it was determined that Hays is incompetent to stand trial.


In Judge Plummer's ruling the court has cancelled all future hearings; a jury trial was set to begin on June 21st at 8:00 am.


A status conference has now been scheduled on August 29, 2023, at 9:00 am.


Hays has been charged on nine counts which include the following:


  • Murder - Sentence possible of 45-65 years, $10,000 fine

  • Reckless homicide - recklessly to kill another human being - Level 3 Felony - Sentence possible of 3-16 Years

  • Domestic battery resulting in serious bodily injury - Level - 5 Felony - Sentence possible of 1-6 years on each Level 5 charges

  • Battery by means of deadly weapon - Level 5 Felony

  • Abuse of a corpse - Level 5 Felony

  • Criminal recklessness committed with a deadly weapon - Level 6 Felony

  • Pointing a firearm at another - Level 6 Felony

  • Obstruction of justice - other or damages or removes any record or document - Level 6 Felony

  • Resisting law enforcement

Original story: December 22, 2022 - Shawn E. HAYS, 53, Mitchell has been arrested for murder and numerous other crimes following a welfare check in the 500 block of Easy Street in Mitchell.


At this time charges are still pending.


The suspect, who is in custody at the Lawrence County Jail.


The victim has been identified as Rodney E. Hays, 73 years old, of 588 Easy Street, Mitchell. Lawrence County Sheriff Deputies found Rodney Hays deceased in front of the residence with a gunshot wound to the head and chest.


His body found mutilated, and partially dismembered. An autopsy is still pending.


Shawn admitted to shooting, mutilating, and partially dismembering the robot who looked like his father.


A search warrant was obtained to investigate the crime scene. Detectives with the Lawrence County Sheriff's Department was assisted by the Indiana State Police Crime Scene Technician.
