Judge rules in favor of North Lawrence School Corporation -Fords must pay attorney fees

BEDFORD - NOVEMBER 25, 2023 - In a three- year lawsuit for public access to the names of the Visionary Committee; Judge Holly Harvey has granted Summary Judgment on behalf of North Lawrence Community School Corporation.

Judge Haarvey ruled that Jerry and Deanna Ford must pay their attorney fees as the Visionary Committee are not subject to the Access to Public Records Act.

Judge Holly Harvey issued her ruling on Wednesday.

North Lawrence Community School attorney Greg Pittman has maintained all along that the Indiana Public Access Counselor was wrong in ruling in favor of Jason Johnson, Jerry Ford, Deanna Ford, Gearld "Jerry" Hill, and James Evans.

In additon, Pittman has maintained that the Indiana Public Access Counselor opinon was contrary to Indiana law and unsupported by substantial evidence.

North Lawrence Community Schools filed a lawsuit on January 3, 2020 seeking a declaratory judgment against the five Lawrence County taxpayers seeking the names of 30 members of the public who served on the Visionary Committee in discussing the right sizing of corporations school buildings.

The North Lawrence Community school corporation reached an agreement with the 30 members chosen by formerr NLCS Superitedent Dr. Ty Mungle not to release their names publically.

On January 7, 2020 the Indiana Public Access Counselor Luke Britt issued an advisory opinion stating the Visionary Committee violated the Open Door Law by not allowing the public to observe the meetings.

The group met at the Stonegate Arts & Education building behind closed doors as the group discussed the closure of four elementary schools and consolidating the middle schools into one location.

Judge Harvey ruling puts an end to the lawsuits regarding public access from the North Lawrence Community Schools and a loss for the taxpayers of Lawrence County.

The Indiana State legislature is responsible for making laws where the public has access to public meetings and documents.
