Judge Plummer declares mistrial in 2nd Day of jury trial in child molestation case

BEDFORD - MARCH 14, 2024 - Lawrence County Superior Court I Judge John Plummer has declared a mistrial on the defense's motion by attorney Daniel Dixon in the second day trial of Joseph Thomas, Bedford.


The jury was seated to hear the case when the defense asked for and was granted a mistrial Wednesday morning.


A Pre-trial hearing is set for April 24, 2024 at 9:00 am.

The case was being presented by Chief Deputy Prosecutor Joshua Scherschel and Deputy Prosecutor Sarah Cummings.


Back in July 7, 2020 following a five month investigation by the Indiana State Police Thomas was arrested on 13 felony counts of incest, 8 counts of child molestation, and two felony counts of criminal confinement.


7 counts of the child molestation has since been dismissed.


The trial was suspected to last four days with Thomas being represented by the Lawrence County Public Defender Agency.
